Secret Vatican Curia dossier critiques Pope’s annulment changes: Mueller warns of harm to Church

ROME, September 14, 2015 (LifeSiteNews) – A growing number of high-ranking Vatican prelates are quietly expressing their dismay over Pope Francis’ recent and sudden Motu Proprio streamlining the process of declaring a marriage null, according to a new report.
On September 10, the German newspaper Die Zeit published an important report about a seven-page dossier that is now being privately circulated in the Vatican among Curial members who are opposing Pope Francis's recent decision to liberalize the process of marriage annulments.
According to the Die Zeit author, Julius Müller-Meiningen, one high-ranking prelate said that with this new Motu Proprio, which makes the process of annulling a marriage much faster and much easier, “Pope Francis has let drop his mask.” “Many Monsignors,” says Müller-Meiningen, “who are officially working at variously central places of the Universal Church, are expressively distressed and very indignant.”
The dossier that criticizes Pope Francis' Motu Proprio has now been widely – though secretly – distributed in the Vatican, especially in the “most important offices in the Vatican, among them in the Congregation for the Doctrine of the Faith and in the Secretariat of the State,” reports Die Zeit. Here are the most important points of the reported criticism, with quotes drawn directly from the dossier itself. They contain all the essential criticisms to be found in the secret dossier, as a source in Rome told LifeSiteNews:
  • The Pope did not consult those commissions in the Vatican which would and should be responsible in counseling him in such an important matter as the annulment process;
  • The Pope introduced de facto a “Catholic divorce”;
  • The normal procedures of the legislation in the Universal Church have been thus levered out;
  • Most of the safeguards in the process of annulling a marriage have been “intentionally 'eliminated'”;
  • “None of the prescribed steps of a legislative procedure have been kept,” according to the dossier;
  • The Bishops' Conferences, the relevant Congregations and Councils and even the Apostolic Signatura (the highest court of the Church also dealing with the annulments) were not consulted;
  • “Already, formally, there are to be found grave defects [in the very making of the Motu Proprio]”;
  • Against the often proclaimed and invited principles of synodality and of “openness” (i.e., “Parrhesia”), the Pope nonetheless decided seemingly rashly to go ahead with the Motu Proprio, even though at the last Synod of Bishops in 2014, there was not yet a “unanimous consent” to carry forth this streamlining move;
  • The viewpoint has now changed, moving away from the concern to preserve marriages. In the Motu Proprio there is no talk anymore about “pastoral and juridical means for the rescue or validation of a marriage”; the fact that they are missing indeed “causes reflection”;
  • All in all, this speedy development is “dangerous”;
  • There is a strong impression that “it is not anymore about stating the truth concerning a concrete marriage bond, but, rather, about declaring to be invalid as many marriages as possible.”
  • That means that, concretely, the Dogma of the indissolubility of marriage is being hollowed out, even though Pope Francis mentions the Dogma twice in his text;
  • The introduction of a 30-day-quick procedure for the formal determination of a possible declaration of nullity of a marriage “contains the danger of introducing the path to a Catholic divorce”; many of the 3600 diocesan bishops in the world will be most probably overwhelmed by this new mission; additionally, the dossier wonders “how many bishops in the world are able to make a trustworthy assessment which also makes them come to the expected moral certainty [about the validity of a specific marriage]”;
  • Many theologically contested problems have been simply ignored by Pope Francis;
  • Several passages in the Motu Proprio contain very vague formulations which are purportedly to help someone decide whether the quick procedure itself ought to be started – such as someone's putatively “lacking Faith” or other reasons that are not unequivocally specified;
  • The consensus of both spouses (or even the complete lack of response by one of them) is a sufficient reason in order to start the quick procedure, all of which is “concerning”;
  • “It is a novelty in the legislation that a legal text ends with the expression 'etc.' and it thus thereby keeps open other options”;
  • Pope Francis did not himself follow the regular procedures of legislation.
According to Die Zeit, one of the Curial members said: “We have to open the mouth now,” indicating the moral obligation to resist the new legislation. As Die Zeit also reports, the head of the Congregation for the Doctrine of the Faith, Cardinal Gerhard Ludwig Müller, fears that the whole edifice of the Catholic Church will collapse, if one removes one of its main foundations by introducing an actual or a seeming Catholic form of divorce. According to another article written by Müller-Meiningen on September 10 in another German publication, Rundschau Online, one Curial member reported that Cardinal Mueller is “deeply indignant” about the fact that he himself was not consulted in the preparation of the new Motu Proprio.
The move by Pope Francis to cut short or bypass a more thorough discussion during the upcoming Synod of Bishops on the Family might now effectively “turn it into a debating club which revolves around itself,” in Müller-Meiningen's own words. And the author then closes his reportage with the question: “Will the pope now implement with all his might his long-designed path, which has at least been sketched out for a long time?” As Müller-Meiningen reported on September 9 in the German newspaper, the Neue Westfälische, circles around Cardinal Müller say that they expect there to be “three weeks of struggle” during the October Synod. Morever, Müller-Meiningen himself acutely continues with the following observation: “The pope – as the critics are now convinced – now acts single-handedly, unilaterally. That he now puts out some of the fires with his new quick reform, is a possibility. The other possibility, however, is that the defenders of the pure [traditional] Doctrine are now becoming even more resistantly uncompromising

CATHOLIC ACTION LEAGUE URGES CARDINAL O'MALLEY
TO REAFFIRM CATHOLIC TEACHING ON MARRIAGE   

The Catholic Action League of Massachusetts today is calling upon Cardinal Sean O'Malley, the Archbishop of Boston, to publicly reaffirm Catholic teaching on the indissolubility of marriage, after a senior member of the Cardinal's own clergy openly derided that teaching as "ludicrous" in the current edition of The Pilot, the official newspaper of the Archdiocese of Boston, whose publisher is the Archbishop.

In a column in the September 11th Pilot entitled "Synod needs your prayers," Monsignor Paul V. Garrity, Pastor of Sacred Heart and Saint Brigid Parishes in Lexington, wrote: "It is ludicrous to assert that divorced couples who have found love and fidelity with new spouses are still recognized by the Church as being married to their former spouses after the passage of many years. It is equally untenable (and disrespectful) to try to convince these happily married couples that, in fact, their relationships are sinful."

Garrity had previously sparked controversy in December, 2013, when he compared same sex couples to the Holy Family in a letter in the bulletin of Saint Catherine of Siena Parish in Norwood.

Roman Catholic teaching on the permanence of the marital bond, which is definitive and irreformable, is founded on Divine and natural law, expressed by the words of Jesus Christ in the Gospel of Saint Matthew: "What therefore God has joined together, let no man put asunder," and in the Gospel of Saint Luke: "Every one who divorces his wife and marries another, commits adultery..."

The Catechism of the Catholic Church, promulgated by Saint John Paul II, states: "Divorce is a grave offense against the natural law...Contracting a new union, even if it is recognized by civil law, adds to the gravity of the rupture: the remarried spouse is then in a situation of public and permanent adultery."

The Catholic Action League called Garrity's column "a shocking disavowal of Catholic morality by a prominent pastor of the Archdiocese of Boston, in the Archbishop's own newspaper."

Catholic Action League Executive Director C. J. Doyle made the following comment: "Garrity's heretical assertions go far beyond the so-called concessions in pastoral practice envisaged by some synod fathers. Garrity unambiguously repudiates, and holds up to public ridicule, the constant, 2,000 year old doctrine of the Catholic Church on the indissolubility of a valid, sacramental marriage. Ordinary Catholics, reading Garrity in a diocesan newspaper published by Cardinal O'Malley, could be led to the erroneous belief that Catholic moral teaching is changeable."

"Although Garrity invokes 'love, forgiveness and mercy', he doesn't practice it. Apparently, for him, the Spiritual Works of Mercy---counseling the doubtful, instructing the ignorant, and admonishing the sinner---are obsolete. Warning the flock of the dangers of mortal sin is intrinsic to the priesthood. For Garrity, such priestly duty is 'disrespectful.'"

"There are three scandals here: that a Catholic pastor would propound such heresy; that an official Catholic newspaper would publish it; and that a Catholic archdiocese, would, by its silence, acquiesce in it. Twice in recent years, lay columnists who wrote opinion pieces in The Pilot critical of homosexuality were forced to clarify their comments. We will see if a different standard applies to a chancery connected cleric who mocks Catholic morality."

A special appeal panel at Beth Israel Deaconess Medical Center (BIDMC) in Boston has upheld the hospital administration’s earlier claim that a physician’s statements to colleagues and staff about the dangers of homosexuality constitute “discrimination,” “harassment,” and “unprofessional conduct,” and that Bible verses regarding homosexuality are similarly “offensive” and discriminatory.

Dr. Paul Church has been a urologist on the BIDMC staff for nearly 30 years and is a member of the Harvard Medical School faculty. He has done research on diagnosing prostate and bladder cancer. He has also spoken on the subject of high-risk sexual behaviors.
In recent years he voiced concerns to colleagues about the hospital’s aggressive promotion of LGBT events and activities. That angered the hospital administration.

Expelled from staff for bringing up uncomfortable medical facts

Recently, Dr. Church was expelled from the staff of BIDMC after he posted  medical concerns about the dangerous practices of homosexual behavior, also two Bible verses, on the hospital’s internal Internet portal.
The hospital did not dispute the truth of Dr. Church’s statements, nor claim that he ever discussed these matters with patients. But they stated that his concerns constitute “discrimination,” “harassment,” and “unprofessional conduct” and may not be discussed.

Appeal denied

Dr. Church requested an internal appeal of his expulsion, as the hospital bylaws allow. On July 29th and 30th, an appeal hearing was held before a special medical panel. On Sept. 9, Dr. Church was notified that the panel voted to uphold the hospital’s earlier decision. The panel also prepared a report explaining its decision, but the report is considered “confidential” according to hospital by-laws and has not been made available.

What this means for all of us

A frightening thing is happening in America’s medical community. Public health is under assault by the pro-homosexual movement. In a manner that can almost be considered demonic, medical truth that could affect millions of people is being censored by “educated” doctors obsessed with the lies of political correctness. It brings to mind the mentality of medical people who continue to defend Planned Parenthood after the unspeakable horrors that have been revealed. As always, along with this mindset goes a near-pathological hatred of Judeo-Christian religious belief. Good people must stand up to this.
There’s also a certain Kafkaesque nature to this. The hospital is using the serious expulsion procedure against Dr. church that’s normally used against physicians who abuse patients or commit some kind of malpractice. Its case is built on a strange dictum that nothing can be posted internally that “could offend” any staff member. But at that same time, the hospital continued to email Dr. Church their pro-LGBT material, even after he asked to be taken off the list, which he (and others) said they found to be offensive. The hospital sees no contradiction at all. This is the brave new world we are entering.

What’s next?

The expulsion must be voted on by the hospital’s Board of Directors, which would likely uphold it, but could also modify or reject it.
However, according to the by-laws, Dr. Church can first ask the Board to conduct an “appellate review” of the hearing panel’s recommendation. There is a separate process for that. However, Dr. Church must show that the panel acted improperly, arbitrarily, with prejudice, or with disregard for the evidence presented. Dr. Church has indicated that he can show that, and that he will seek such a review in the next week.

Did MassResistance’s leafletting of the hospital help?

We think it was very important. On various occasions over the past month, MassResistance activists have protested and heavily leafletted at BIDMC. Almost no one knew about Dr. Church’s expulsion, and lots of people were quite shocked and upset. From other information we received, we are confident that the hospital management received considerable negative feedback about this. But in this case, their continuing obsession with cooperating with the LGBT movement and their internalized disdain for traditional religious values may have been too much to overcome – for now.

Continued news blackout in Boston

This is a textbook case of why the mainstream media should not be trusted.
In Boston, the mainstream media has continued its blackout of the Dr. Church issue. In general, the Boston media reports on anything controversial. But we suspect that the issue of the dangers of homosexual behavior is something they don’t want to discuss in any unbiased manner – and they simply believe that any discussion of it is “homophobic” and not worth reporting. For example, The Boston Business Journal, a relatively small publication, actually did report on it, but depicted Dr. Church as posting "anti-gay comments."
The Boston Globe, Boston Herald, and the Boston office of the Associated Press all acknowledged receiving information about the Dr. Church issue, and all have declined to write about it, despite multiple calls. Nor have any Boston TV stations picked it up. 
Probably most disappointing is that Boston’s “conservative” radio talk show host, Jeff Kuhner of WRKO 680 AM, has refused to bring it up it on his show, despite numerous requests. Given the wide range of conservative topics he brings up on his show, this is very unsettling.
The national mainstream media has also stayed away from the story. Fox News, Wall Street Journal, New York Times, Washington Post, USA Today and even the Blaze received material but declined to act on it.

It’s been left to the national pro-family conservative press to carry the ball on this. WorldNetDaily, LifeSiteNews, The New American, American Family Association,, American Family Radio, and many websites and blogs have faithfully covered this, including the Association of American Physicians.
And around the world, we’re finding a surprising amount of interest, from Hong Kong to Britain and beyond.
Even in Hong Kong they're talking about this. But the Boston news media won't touch it.

We see this as a much larger outrage that will have national implications if allowed to go on unabated. We are not letting up on our fight to support Dr. Church, one of the most courageous people in America right now, in his stand against what is truly the culture of death.

DEFUND PP RALLY HELD IN BOSTON

HUNDREDS RALLY TO DE-FUND PLANNED PARENTHOOD

Nearly 300 supporters of the Right to Life gathered this morning for a rally and prayer vigil in front of the Planned Parenthood facility on Commonwealth Avenue in Boston. The event was part of a National Day of Protest against the abortion giant. More than fifty pro-life organizations in three hundred communities across the United States staged demonstrations today calling for the de-funding, investigation and criminal prosecution of Planned Parenthood.

The protests came after shocking revelations that Planned Parenthood harvests and merchandises the organs of the pre-born children it destroys in abortions, haggles over prices in fetal parts trafficking, and even performs partial birth abortions to procure body parts.

The Boston rally was organized by Operation Rescue: Boston and 40 Days For Life. Among the groups participating was the Catholic Action League of Massachusetts, whose Executive Director, C. J. Doyle, addressed the assembled protesters.

In his remarks, Doyle criticized the various Catholic educational institutions and religious orders who---contrary to explicit church policy---have given honors, awards and platforms to elected officials who have been endorsed by Planned Parenthood. Among the examples cited by Doyle was the decision of Jesuit administered Boston College to invite Secretary of State John Kerry to deliver the 2014 commencement address; similar invitations by BC Law School to U. S. Senator Ed Markey and Connecticut Governor Dannel Malloy; the 2015 address by Georgia Congressman John Lewis to graduates of Our Lady of the Elms College in Chicopee; and the Humanitarian Award given in 2014 to State Representative Kevin Honan by the Sisters of Saint Joseph in Boston.

Doyle also criticized Boston College for offering student internships directly with Planned Parenthood.

Doyle said:"Pro-Life Catholics should not be forced to wage a two front war---against a culture of death in secular society, and against a culture of betrayal in our own Church. We cannot hope to persuade our fellow citizens of the justice of our cause, if that cause is not first vindicated and upheld in our own religious institutions, which profess to be and which ought to be pro-life. If we are to defeat Planned Parenthood, we must reform the Catholic Church."
